Photo & Video Disclaimer

Mendocino Railway (“we,” “us,” or “our”) operates websites and consumer-facing rail experiences, including our Skunk Train and River Fox Train. Photography, video, audio, and similar recordings may occur at our trains, Railbikes, stations, events, attractions, retail areas, and other public or guest-accessible areas.

By entering or remaining in those areas, or by participating in our experiences or events, you acknowledge that you may be photographed, filmed, or recorded. Except where prohibited by law, you authorize us to use your name, image, likeness, voice, appearance, statements, and recordings for advertising, publicity, promotional, social-media, archival, internal, security, training, and other lawful business purposes, without additional compensation, notice, review, or approval. We may request a separate written release before using a person’s name, image, likeness, voice, statements, or recordings in a featured advertising campaign, testimonial, endorsement, or other prominent promotional use.

We do not use this notice to seek permission to publish private contact details, payment details, government-identification information, tax information, or other sensitive administrative information. We also do not intentionally identify a guest by full name in connection with photos or videos, or disclose personal identifying information in that context, without consent or another appropriate basis.

If you are a parent or legal guardian accompanying or otherwise responsible for a minor, you consent to this notice on the minor’s behalf, except where prohibited by law.

If you do not want to be photographed, filmed, or recorded, please notify a team member before or during your visit so we can discuss reasonably available options. We may not be able to prevent incidental appearance in recordings made in public or guest-accessible areas.

We may use and retain recordings as reasonably necessary for safety, security, operations, incident response, claims handling, legal compliance, and similar purposes.
